Acceptable Use Policy

Last updated October 22, 2026

This Acceptable Use Policy (“AUP”) describes what you may and may not do with memberbeam. It applies to every Organization, Admin, and other user of the Service, and to all content sent, published, or collected through the Service, including emails, SMS messages, websites, forms, waivers, and wallet passes.

This AUP is part of our Terms of Service. Capitalized terms not defined here have the meanings given in the Terms. If you violate this AUP, we may take the actions described in Section 9.

We built memberbeam for associations, clubs, nonprofits, and community groups, and the vast majority of our customers will never need to think about this policy. It exists to protect your Members, other customers, and the reputation of the Service, including the email and SMS sending reputation that every Organization shares.

1. General rules

You must not use the Service to:

  • break any law or regulation, or encourage others to do so;
  • infringe anyone’s intellectual property, privacy, publicity, or other rights;
  • harass, threaten, bully, defame, or intimidate any person or group;
  • promote violence, terrorism, or hatred against people based on race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation, age, or similar characteristics;
  • publish or distribute child sexual abuse material, or content that sexualizes minors in any way, which we will report to the appropriate authorities;
  • publish sexually explicit material;
  • distribute malware, viruses, or other harmful code;
  • collect personal data deceptively, or without the notices and consents required by law; or
  • engage in fraud, phishing, scams, pyramid or multi-level marketing schemes, or other deceptive practices.

2. Impersonation and misrepresentation

You must not:

  • impersonate any person, organization, government body, or brand, including memberbeam;
  • create websites, emails, forms, or wallet passes that are designed to look like they come from someone else;
  • misrepresent your Organization’s identity, charitable or tax-exempt status, affiliation, or purpose;
  • claim that donations are tax-deductible when they are not; or
  • use memberbeam to collect money for a purpose other than the one you describe to payers.

If you run a chapter or affiliate of a larger organization, you must have that organization’s permission to use its name and branding.

3. Email rules

Every Organization’s email shares sending infrastructure and reputation. To protect deliverability for everyone, you must follow these rules.

  • Only send marketing or promotional email to people who have given permission to hear from you, or with whom you have an existing relationship that allows you to email them under applicable law, such as current members.
  • Keep records of how and when consent was obtained, and provide them to us on request.
  • Follow the consent rules of each recipient’s country. For example, recipients in Canada, the European Union, the United Kingdom, Australia, and New Zealand generally require express or clearly implied consent.

3.2 No purchased or scraped lists

You must not send email to lists that you have bought, rented, borrowed, or shared from another organization, or that were scraped or harvested from websites, directories, or social media. This applies even if the seller says the list is “opt-in”.

3.3 Unsubscribe

  • Every marketing email must include a working unsubscribe link. memberbeam adds one automatically, and you must not remove, hide, or disable it.
  • You must honor unsubscribe requests promptly, and in any case within the time required by law. memberbeam does this automatically when the unsubscribe link is used. If someone asks to unsubscribe in another way, you must update their preferences yourself.
  • You must not re-add unsubscribed people to a mailing list without their fresh consent.

3.4 Identification and content

  • Emails must clearly identify your Organization as the sender and include a valid physical postal address.
  • Subject lines and sender names must not be misleading.
  • Transactional messages, such as receipts, renewal reminders, and event confirmations, must not be used as a vehicle for unrelated marketing where the law does not allow it.

3.5 List quality

We monitor bounce rates, spam complaints, and unsubscribe rates. If your sending causes complaint or bounce rates materially above industry norms, we may pause campaigns while we work with you to clean your list. As a guide, spam complaints should stay below 0.1% and hard bounces below 2% of messages sent.

4. SMS rules

SMS is closely regulated in many countries. If you use memberbeam’s SMS add-on, you must:

  • obtain prior express consent from each recipient before sending them SMS messages, and prior express written consent where required, such as for marketing messages to US numbers under the Telephone Consumer Protection Act;
  • keep records of consent, and provide them to us on request;
  • clearly identify your Organization in each message;
  • honor opt-out requests immediately, including standard keywords such as STOP, UNSUBSCRIBE, END, QUIT, and CANCEL, which memberbeam processes automatically;
  • respect quiet hours and time-of-day restrictions that apply in the recipient’s location;
  • not send messages to purchased, rented, or scraped phone number lists;
  • not send content that is prohibited by carriers or our SMS provider, including content relating to cannabis, firearms, high-risk financial services, debt collection, or sexual content; and
  • complete any sender registration that carriers require, such as US 10DLC or toll-free verification, and provide accurate information when doing so.

5. Payments and prohibited businesses

Online payments in memberbeam are processed through each Organization’s own Stripe account (and optionally GoCardless). You must comply with the terms of those providers, including the Stripe Restricted Businesses list, in addition to this AUP.

You must not use the Service to accept payments for, or to promote:

  • illegal goods or services, or goods or services that facilitate illegal activity;
  • weapons, firearms, ammunition, explosives, or their components;
  • illegal drugs, controlled substances, drug paraphernalia, or products that make unproven health claims;
  • cannabis or cannabis products, where prohibited by our payment providers;
  • adult content or services, including escort services;
  • gambling, lotteries, raffles, sweepstakes, or games of chance, except where you hold any license required by law and your payment provider permits it;
  • cryptocurrency, virtual currency, or securities offerings;
  • money transmission, check cashing, debt collection, or credit repair;
  • multi-level marketing, pyramid schemes, or get-rich-quick schemes;
  • counterfeit or unauthorized goods;
  • goods or services that infringe intellectual property rights;
  • fundraising for individuals or causes in a way that is deceptive, or that breaches charitable solicitation laws; or
  • any business or activity that your payment provider has not approved for your account.

Even where an activity is lawful, you must not use the Service to make payments that you know or suspect are fraudulent, to process payments on behalf of another organization, or to split or structure transactions to avoid Platform Fees, payment provider limits, or legal reporting requirements.

6. Digital waivers and forms

When you use forms, surveys, or digital waivers, you must:

  • present documents honestly and not hide material terms;
  • only collect the information you need, and only sensitive information such as health data where you have a lawful basis and a genuine need;
  • make sure the person signing is who they say they are, to a standard appropriate for your purposes, and that anyone signing on behalf of a minor is the minor’s parent or legal guardian;
  • not sign, alter, or backdate a document on behalf of another person; and
  • not tamper with, remove, or misrepresent the audit trail that memberbeam records for a signed document.

7. Wallet passes, websites, and custom domains

  • Wallet passes must accurately represent the membership, ticket, or credential they relate to, and must not be designed to mislead, such as by imitating government identification.
  • Pass update notifications must relate to the pass, such as a renewal, change in status, or event information. They must not be used to send unrelated marketing.
  • You must own, or be authorized to use, any domain you connect to memberbeam.
  • You must not use memberbeam websites to host content unrelated to your Organization, or to redirect visitors to deceptive or malicious sites.

8. Security and system integrity

You must not:

  • attempt to access accounts, data, or systems you are not authorized to access, including other Organizations’ data;
  • probe, scan, or test the vulnerability of the Service without our prior written permission, except under our responsible disclosure process described below;
  • interfere with or disrupt the Service, its servers, or networks, including through denial-of-service attacks;
  • bypass rate limits, Plan limits, authentication, or other security measures;
  • use the API or automated tools in a way that places an unreasonable load on the Service;
  • share Admin accounts between multiple people, or sell or transfer access to your Account; or
  • use AI features to generate content that violates this AUP, or attempt to make AI features produce harmful output.

Responsible disclosure

We welcome reports from security researchers. If you believe you have found a vulnerability, email security@memberbeam.com with details. Please give us reasonable time to fix the issue before making it public, and do not access, modify, or delete data that is not yours.

9. Enforcement

If we reasonably believe you have violated this AUP, we may, depending on the severity of the violation:

  • contact you and ask you to correct it;
  • remove or disable the content concerned;
  • pause email campaigns, SMS sending, or other features;
  • suspend or terminate Admin access or your Account, as described in the Terms; and
  • report the activity to law enforcement, payment providers, or other appropriate parties.

Where practical and lawful, we will give you notice and a chance to fix the problem first. We may act without notice where the violation is serious, poses a risk to others, or is required by law. We are not obligated to monitor content, but we may review it where we have reason to believe this AUP has been violated.

10. Reporting abuse

If you see something in memberbeam that violates this policy, such as spam, a phishing page, a fraudulent fundraising page, or content that infringes your rights, please report it to legal@memberbeam.com. Include:

  • the URL, email, or SMS message concerned, with full headers for email where possible;
  • a description of the issue; and
  • your contact details, if you would like us to follow up.

For copyright or trademark complaints, please also include identification of the work or mark concerned, a statement that you have a good-faith belief the use is not authorized, and a statement, under penalty of perjury, that the information in your notice is accurate and that you are the rights holder or authorized to act on their behalf.

Report security vulnerabilities to security@memberbeam.com.

11. Changes to this policy

We may update this AUP from time to time to respond to new risks, legal changes, or requirements of our providers. We will post the updated policy here and change the date at the top. Where a change materially affects how you use the Service, we will notify you in advance in accordance with the Terms.
